A tax lien arises automatically when the taxpayer fails to pay an assessed tax, and the IRS does not need to take any action to validate the lien. A tax lien is generally valid against a third party however, only if the IRS timely files a Form 668(Y) (Notice of Federal Tax Lien) with the appropriate authority.
